Online Privacy Bill Introduced in the Senate
On May 9th, US Sen. Jay Rockefeller (D-WV) introduced an online privacy bill that stipulates the creation of a Do Not Track mechanism which would permit consumers to opt-out of behavioral tracking both online and on mobile devices. Under the Do Not Track Online Act of 2011, the Federal Trade Commission has the authority to set the requirements for the mechanism and penalize companies that violate consumers’ choice to opt-out. State attorneys general could prosecute violating entities with civil penalties that could reach $16,000 per day for every day that a company is in violation, with aggregate penalties up to $15 million. Under the act companies would, however, be allowed to gather certain consumer information needed in order to accommodate an individual for a requested service.
